The judgment of the tribunal is as follows: The tribunal does not have jurisdiction to hear the claimant’s unfair dismissal claim, because:(1) the claimant does not have the requisite 2 years’ continuity of service to bring a claim of unfair dismissal under s.94 of the Employment Rights Act 1996 (ERA); and(2) she does not assert that she made a protected disclosure, and she therefore cannot therefore bring a claim under ss.47B or 103A ERA.
