The claim is struck out.REASONS
[1]By a letter dated 14 October 2022 the Tribunal gave the claimant an opportunity to write by 20 October 2022 make representations or to request a hearing, as to why the claim should not be struck out because it has not been actively pursued.[2]The claimant has failed to make representations in writing and has failed to ask for a hearing.[3]The Respondent made an application dated 20 September 2022, to which the Claimant did not respond. The correspondence with that application showed that the Respondent's representative had written to the Claimant on 1 August, and, having had no reply sent a chaser on 15 August 2022, threatening to make a strike out application if there was no response. The Claimant then wrote to the Respondent's representative on 15 and 22 August, promising to supply documents, but had not done so by 20 September 2022.[4]The Respondent's representative sent further emails to tribunal on 27 September, 4 October, and 11 October, all of which were copied to the Claimant.[5]The Claimant has not responded to any of the above and is not actively pursuing his claim. The claim is therefore struck out.[6]The hearing fixed for 24 to 27 October 2022 is cancelled and will not take place.
