JUDGMENT
[1]The Tribunal determines that it is necessary in the interests of justice to set aside its decision to accept this Claim, the Respondent having not been afforded a reasonable opportunity to make representations before it was accepted.[2]The Claim solely comprises of “relevant proceedings” within the meaning of section 18 of the Employment Tribunals Act 1996 (the “1996 Act”).[3]When the proceedings were instituted on 24 April 2022 ACAS had not issued a certificate to the Claimant pursuant to section 18(4) of the 1996 Act. By reason of section 18(8) of the 1996 Act, the Tribunal had no jurisdiction to consider this Claim at that stage and it is therefore rejected.
