The complaints of unfair dismissal and disability discrimination are struck out.REASONS
[1]The Claimant failed to attend the Preliminary Hearing on the 17 August 2018.[2]Employment Judge Warren made an order that: ‘By no later than 17 September 2018 the Claimant is to provide to the tribunal, to be copied to the Respondent’s representative , written evidence of his inability to attend the preliminary hearing today’.[3]As there was no response to that Order Employment Judge Laidler gave notice to the Claimant by letter of the 15 October 2018 that she was considering striking out the claims for non compliance with that Order and because it appeared the claim was not being actively pursued. 2. The claimant has failed to make representations in writing, why this should not be done or to request a hearing. The complaint of unfair dismissal and disability discrimination are therefore struck out.
