JUDGMENT
[1]By reference to the agreed Schedule of Allegations – Schedule 1, the claimant’s specific complaints identified as Detriments 7 and 8 are out of time and it would not be just and equitable to extend time. Accordingly those complaints are struck out.[2]In accordance with rule 37 of the Employment Tribunal Rules 2013, the claimant’s allegations or arguments set out below have no reasonable prospect of success and are struck out: 2.1. Detriment 1; 2.2. Detriments 7 and 8 (in the alternative to paragraph 1 above); 2.3. Detriment 9; 2.4. Detriments 11 and 14 in part only, namely complaints advanced under ss13, 26 and 27 of the Equality Act 2010 (EqA); 2.5. Detriment 16; 2.6. Detriment 19; and 2.7. Detriment 22.[3]For the avoidance of doubt, the claimant’s complaints of failure to make reasonable adjustments (ss20-22 EqA) and discrimination arising from Case Number 3304362/2018 (V) disability (s15) in respect of Detriments 11 and 14 (referred to at 2.4 above) are not struck out and remain extant.
