Mr N Scott v Spelthorne Borough Council: 3304323/2020

EMPLOYMENT TRIBUNALS
Case No 3304323/2020
Mr N ScottClaimantSpelthorne Borough CouncilRespondent
Employment Judge AnstisDate 6 May 2021

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 15 April 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:  the claimant had not responded to the tribunal’s letters dated 30 December 2020 and 4 March 2021, and  it has not been actively pursued.[2]On the day the deadline for response to that letter expired, the claimant submitted what appears to be a copy of his original grievance and a number of sick notes from 2019. As pointed out by the respondent, those do not amount to any form of response to the tribunal’s letter of 15 April 2021. They are also not what was required by the letter of 30 December 2020 and subsequent chasing letter on 4 March 2021. The claimant has failed to make any sufficient representations why his claim should not be struck out on account of the matters set out above, nor has he requested a hearing. The claim is therefore struck out.[3]The hearing fixed for 16 June 2021 will not take place.
