JUDGMENT
[1]The respondent failed to pay the claimant for 81.5 hours’ work done between 24 January 2022 and 10 February 2022 inclusive at the rate of £8.91 per hour. The claimant is therefore entitled to the sum of £726.16 gross, i.e. before the deduction of income tax and national insurance contributions, by way of unpaid wages.[2]The respondent failed to pay the claimant any holiday pay for the whole of the claimant’s employment (which was from 10 April 2021 to 10 February 2022 inclusive). The claimant was employed under a zero hours contract. Her weekly pay for the purposes of the Working Time Regulations 1998, SI 1998/1833, was £219.00 gross. The claimant is accordingly entitled to 307/365 x 5.6 x £219.00 by way of unpaid holiday pay, which is £1,031.52 gross.
