JUDGMENT

[1]The complaint that the claimant was unfairly dismissed is struck out.[2]As a result of this decision, the entire claim is at an end.

REASONS

[1]The claimant complains of unfair dismissal.[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years service to make an unfair dismissal complaint. The claimant was employed by the respondent for less than two years.[4]Therefore, by letter dated 19 May 2023, the claimant was warned that his complaint would be struck out, unless, by 2 June 2023, he objected to that proposal and supplied reasons.[5]The claimant has failed to reply.[6]Accordingly, the complaint of unfair dismissal is struck out on the basis that it has no reasonable prospect of success, and is not being actively pursued.
