[1]The Claimant’s claim is dismissed pursuant to rule 37(1)(d).REASONS
[1]On 18 October 2021, the Tribunal stayed the Claimant’s claim as the respondent company was in administration. The stay was intended to afford him an opportunity to obtain the consent of the Administrator for the claim to proceed, or permission from the court.[2]From the Claimant’s subsequent correspondence it is apparent that he has asked the Administrator to consent and this request was refused.[3]There is no evidence of the Claimant having applied to the Court.[4]In the circumstances (and accepting the Administrator’s stance is a matter outwith the Claimant’s control) the claim is not being actively pursued.
