JUDGMENT
[1]The claimant’s application to have the response struck out on the grounds that the respondent has failed to comply with orders and/or that the defence is no longer actively pursued is refused, however an unless order was made against the respondent regarding a separate case management hearing.[2]The respondent is ordered to pay the claimant’s cost in connection with today’s hearing, particularly a contribution towards the claimant’s solicitor’s costs in the total sum of £300 plus VAT and counsel’s brief fee for today’s hearing of £600 plus VAT, making a total order for costs payable by the respondent to the claimant in the sum of £900 plus VAT.
