EMPLOYMENT TRIBUNALS
Case No 3303906/2020
Mr A Duckett-McDowallClaimantBSS UK LimitedRespondent
Employment Judge KurreinDate 11 May 2021

JUDGMENT

The claims of unfair dismissal and sexual orientation discrimination are struck out.

REASONS

[1]The claimant was ordered to pay a deposit of £450.00 following a preliminary hearing held on 15/01/2021. The Order was sent to the claimant on 16/03/2021. The claimant has failed to pay this deposit. The complaints of unfair dismissal and sexual orientation discrimination are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013. Employment Judge Kurrein Date: 23 March 2021[1]By a letter dated 25th March 2021 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the Claimant have not complied with the Case Management Orders of the Tribunal dated 23rd February 2021, failing to provide the medical evidence of why you did not attend the hearing of 15th January 2021, and it has not been actively pursued.[2]The Claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
