The claim is dismissed.REASONS
[1]The claimant presented a complaint on 11 April 2024. There has been no response to the claim. The claimant has not communicated with the employment tribunal since commencement of the claim.[2]A final hearing was listed to take place on 28 July 2025, however that hearing date was postponed because there was no judge available to hear the claim on that date. The case was re-listed for hearing on 24 September 2025.[3]The claimant did not attend the video hearing. The respondent did not attend the video hearing. If a party fails to attend or to be represented at a hearing, the Tribunal may dismiss the claim or proceed with the hearing in the absence of that party. Before doing so it must consider any information which is available to it, after any enquires that may be practicable, about the reasons for the party’s absence.[4]I have considered the available information and conclude that the claim is not being actively pursued by the claimant and therefore in the circumstances I decided to dismiss the claim.
