JUDGMENT
On the Respondent’s Application to Strike Out the Claimant’s Claim COVID-19 Statement on behalf of Sir Ernest Ryder, Senior President of Tribunals This has been a remote hearing on the papers which had not been objected to by the parties. The form of remote hearing was by telephone (A). A face to face hearing was not held because it was not practicable during the current pandemic.[1]Given the Claimant’s non-attendance at this morning’s telephone remote hearing and looking at the history and background of this claim, in particular the Claimant’s continued non-compliance with Judge’s Orders and the failure to provide medical evidence in the form of a GP report, the claim is clearly no longer actively pursued.[2]The Claimant’s claims of constructive dismissal and claims under the Equality Act 2010 for the protected characteristic of disability are dismissed.
