JUDGMENT
[1]The Claimant’s claim of unlawful deduction of wages succeeds. It is declared that the Respondent made an unlawful deduction of wages and the Respondent is ordered to pay the Claimant the sum of £3,833.33 in respect of that claim (one month’s pay).[2]The Claimant’s claim of breach of contract succeeds and the Respondent is ordered to pay the Claimant the further sum of £3,3833.33 in respect of that claim (one month’s pay).[3]Pursuant to s.38 of the Employment Act 2002 the Respondent is ordered to pay the Claimant the sums of £2,100 (four week’s pay subject the statutory maximum for this purpose of £525 per week) in respect of non-compliance with the obligation to provide particulars of employment compliant with sections 1 and 4 of the Employment Rights Act 1996.
