JUDGMENT

[1]The Claimant’s Claim is dismissed as a result of the Claimant failing to attend the Hearing.[2]The Respondent’s counter-claim is dismissed upon withdrawal by the Respondent.

REASONS

[1]The case was listed for a Hearing to be conducted over the telephone. Mr James Barker the Respondent’s Managing Director was on the line to participate in the Hearing. The Claimant did not attend. I attempted on several occasions to telephone the number that I had been given. The line did not appear to be “live” and no alternative number was given. Mr Barker informed me that he had had no communication from the Claimant since about March 2021.[2]In the absence of the Claimant attending the Hearing I was unable to hear any evidence in support of her Claim against the Respondent. That Claim is therefore dismissed. Mr Barker informed me that in the circumstances he had no intention of proceeding with the employer’s Claim (counterCase Number: 3303212/2021 claim) that he had pursued in the Response. Consequently the employer’s Claim is dismissed upon withdrawal by the Respondent.
