JUDGMENT
The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to the Claimant in the sum of £480.REASONS
[1]At the commencement of this hearing I explained to the parties that the Claimant did not have sufficient qualifying service to claim ordinary unfair dismissal (none of the grounds of automatic unfair dismissal were disclosed on his claim form). I also explained that damages for breach of contract are limited to pay and benefits during the contractual notice period (in this case 1 week).[2]Mrs Sheahan conceded that it did not seem from the payslips disclosed that the Claimant had received pay in lieu of notice.[3]After discussion the parties agreed that the damages payable are £480 (including tips) and I entered judgment accordingly.
