JUDGMENT

[1]The respondent has failed to comply with a requirement of section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992. The claim for a protective award succeeds. (2) The Tribunal makes a protective award in respect of the claimants, all of whom worked at the respondent’s establishment at 2 Lodge Way, Lodge Farm Industrial Estate, Northampton and were dismissed as redundant on or after 11 December 2019 that the employer pay remuneration for the protected period which begins on 11 December 2019 and is for a period of 90 days. The Recoupment Regulations apply. [1]By a letter dated 13 July 2023 the Tribunal gave the claimants an opportunity to make representations or to request a hearing, as to why the claims should not be struck out because they have not been actively pursued.[2]The claimants have failed to make representations in writing, or have failed to make any sufficient representations, why this should not be done or to request a hearing. The claims are therefore struck out.
