JUDGMENT
[1]The Respondent is insolvent as it is clear it cannot pay its debts as they fall due.[2]The claimant’s claims for unlawful deductions from wages/arrears of pay are well founded.[3]The claimant’s claims for income tax that is apparently unpaid by the Respondent to HMRC and for a payment for stress and inconvenience are dismissed. REMEDY 1 The claimant is entitled to payment of the sum of £926.09 (net) for unpaid pay between 1 and 6 January 2023 and the sum of £1090.33 for unpaid employee pension contributions between August and December 2022. PHCM Order 1 of 2 September 2023 Case Number: 3303071/2023 Note: The respondent also failed to make employer contributions to the employee’s pension scheme with Aviva of £1090.33 between August and December 2022. The claimant intends to notify the Aviva pension scheme trustees to seek this sum from the respondent and/or the National Insurance Fund. The claimant also wishes it to be noted that she intends to seek payment of the sums in 1 above from the National Insurance Fund.
