Miss L Pearce v Nature's Nursery (Ascot) Ltd: 3303025/2015
REASONS
[1]Rule 72 (1) of the Employment Tribunals Rules of procedure 2013 provides that an Employment Judge shall consider any application made under rule 71. If the Judge considers that there is no reasonable prospect of the original decision being varied or revoked the application shall be refused.[2]The application for a reconsideration is refused because it has no reasonable prospects of success. The Tribunal found that the there was a repudiatory breach of contract as explained in the judgment. The Tribunal did not find culpable conduct on the part of the claimant justifying a conclusion that it is just and equitable to reduce either the basic award or the compensatory award.
