Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claims for redundancy payment, arrears of pay, holiday pay and notice pay are dismissed upon withdrawal.[2]The unfair dismissal claim succeeds. There is no basic award as the claimant has received a redundancy payment. Taking account of the schedule of loss, and the likelihood of the Claimant being dismissed at the end of a fair procedure, the compensatory award made is £500 for loss of statutory rights plus around 4 weeks net pay and pension contributions. Therefore the Respondent is ordered to pay the Claimant £2275 as compensation for unfair dismissal.[3]This does not affect the claim for a protective award which is the subject of separate orders.
