Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £3426.[2]The respondent has failed to pay the claimant’s holiday entitlement (pay in lieu on termination). However, the claim was not brought within the relevant time limit. (The claim would have had to be presented, or ACAS conciliation commenced, at least, by no later than 28 February 2023; conciliation was not until 22 March 2023, with the claim being presented 27 March 2023). It was reasonably practicable to bring the claim in time and therefore the Tribunal does not have jurisdiction to make an award. This does not necessarily prevent the Claimant seeking a payment from government funds.
