Mr R Ferguson v GXO Logistics UK Ltd: 3302740/2023
REASONS
[1]The Claimant failed to attend today’s hearing and offered no explanation for his non-attendance. I made three attempts to contact him using the BT meet-me conferencing facility and by phoning him directly.[2]I am satisfied that the Claimant was aware of today’s hearing as Notice of the Hearing was send to him at the email address he provided to the Tribunal on his claim form and which he also used on 27 April 2023 to write to the Tribunal.[3]Since July this year the Claimant has not engaged with the Tribunal or the Respondent. He has not complied with the Tribunal’s Orders for him to provide further information about his claim or a remedy statement, nor did he complete and submit the Agenda for Case Management sent to him by the Tribunal on 17 July 2023. The Respondent tells me that the Claimant has not responded to its emails of 17 July, 11 and 21 August 2023.[4]It is the Claimant's responsibility to progress his claim, engage with the Tribunal and the Respondent, and comply with the Tribunal’s Orders. Since 17 April 2023 he has taken no action to pursue his claim. Case Number: 3302740/2023[5]Having regard to the power in Rule 47, I am satisfied that it would be just and equitable to dismiss the claims, the Claimant having been given reasonable prior notice of the hearing and having failed to offer any explanation for his non-attendance.
