JUDGMENT

The complaint of unfair dismissal contrary to s.94 Employment Rights Act 1994 is struck out under rule 38 Employment Tribunals Procedure Rules 2024

REASONS

[1]The claimant, at the time of his effective date of termination, had less than two years’ service; under s.108 Employment Rights Act 1994, two years’ continuous employment is needed in order to gain the right not to be unfairly dismissed under s.94 Employment Rights Act 1996.[2]The claimant was warned in the hearing before Employment Judge Dick on 17 December 2024 that he would have to show a good reason why the unfair dismissal complaint should continue despite him not having two years’ service. He has not done so and, accordingly, that complaint is struck out because it has no reasonable prospects of success. This does not affect his complaints under the Equality Act 2010 that he was constructively dismissed and that that was unlawful discrimination. Approved by:
