JUDGMENT

[1]In the absence of an ET3 response form from the respondent, and there being sufficient material before me to enable a proper determination to be made, I uphold the claim by Mr Jabbar that he was unfairly dismissed by Huckleberry’s Chicken Limited.[2]The claimant is awarded a basic award of £2690[3]The claimant is awarded a compensatory award of £17,160[4]Huckleberry’s Chicken Limited breached s86 Employment Rights Act 1996 in that no notice was given to Mr Jabbar nor was he paid in lieu. The claimant is awarded £3,000 in respect of notice pay under the s86 Employment Rights Act 1996.[5]Huckleberry’s Chicken Limited breached the Working time Regulations 1999. Mr Jabbar is awarded £3,360 in respect of holiday pay under the Working Time Regulations 1999.[6]The claims against Fastfood Recruitment Limited are dismissed in their entirety.
