Employment Judge LaidlerDate 26 February 2021

JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has not filed a response to the claim.[2]In default of such a response the claimant’s claim of unfair dismissal succeeds.[3]The claimant is to file a schedule of loss within 14 days of this Judgment being sent to the parties. _____________________________ Employment Judge Laidler Date: 15/10/2020

REASONS

[1]Judgment in default of a Response was entered on the 15 October 2020.[2]By letter of the 23 October 2020 the respondent advised the tribunal that it had filed a Response on the 1 April 2020 in accordance with an extension of time granted to it expiring on the 8 May 2020.[3]As the Response was not on the tribunal file the respondent was directed to provide evidence of filing the Response in a letter from the tribunal of the 2 December 2020.[4]In a letter of the 3 December 2020 the respondent provided the evidence sought. This was not seen by the judge until the 12 February 2021. This demonstrated that the Response was filed on line on the 1 April 2020.[5]The Response having been filed in time the judgment entered is set aside. _____________________________ Employment Judge Laidler 12 February 2021[1]The respondent has not filed a response to the claim.[2]In default of such a response the claimant’s claim of unfair dismissal succeeds.[3]The claimant is to file a schedule of loss within 14 days of this Judgment being sent to the parties.
