JUDGMENT
[1]The deposit order sent to parties on 18 March 2025 gave a time and date time for payment as 4pm on 14 April 2025.[2]The deposit was not paid by that date. [My decision is that HMCTS records are accurate meaning, the date of payment was 16 June 2025. However, even if HMCTS records are wrong, the postal order making payment was received by HMCTS no earlier than 15 June 2025.][3]As a consequence, by operation of Rule 40(4), the allegation or argument that the unfair dismissal claim was in time has to be struck out.[4]However, the judgment in paragraph 3 is revoked. I extend time for the payment of deposit to 16 April 2025. The deposit is therefore deemed to have been paid in time (the consequences of which are set out in the appendix to the order sent on 18 March 2025 and in Rule 40). Case No: 3302527/2024[5]Therefore, the unfair dismissal complaint does not stand struck out.[6]The unfair dismissal complaint is subject to case management orders sent separately.
