JUDGMENT
[1]The claimant’s equal pay claim was dismissed upon withdrawal at the hearing.[2]Save for his complaint of discrimination arising from disability contrary to s15 Equality Act 2010 (regarding his dismissal only) the claimant’s remaining claims of unfair dismissal and disability discrimination are struck out. The tribunal has no jurisdiction to hear any of his complaints because they are out of time and where relevant the claimant has no reasonable prospect of establishing that the claims have been brought in time having regard to s123 Equality Act 2010. Detailed reasons for this Judgment were given extemporaneously at the hearing.[3]After the tribunal delivered its judgment on the preliminary issues in this case, the claimant wrote to the tribunal on 23 January 2023 withdrawing his claim against the respondent. Therefore, the remaining claim under s15 Equality Act 2010 is dismissed upon withdrawal.
