The claim is struck out.

REASONS

[1]The matter was listed today to determine the case. The respondent wrote in advance to request a strike out of the claims as they were not being actively pursued. The claimant had failed to comply with the case management order dated 25th May 2022 in that she had failed to provide disclosure and failed to provide a witness statement. The respondent had had no response to correspondence from her. The claimant then failed to attend today. An adjournment was taken to allow further time in case the claimant was simply late. Accordingly, I strike out the claimant’s claims both on the grounds of the application and on my own initiative for the following reasons.  it has no reasonable prospect of success on the papers I have seen today.  the claimant had not complied with the Order of the Tribunal dated 25th May 2022.  it has not been actively pursued. 6.2 Strike out Judgment – claim - rule 37 1 Case Number: 3302314/2022[2]The claimant has failed to attend the final hearing to determine her claim and failed to engage in the Tribunal process. The claim is therefore struck out.
