JUDGMENT

[1]It is declared that the Secretary of State ought to pay to the claimant out of the National Insurance Fund the following amounts to which the claimant is entitled(i) Arrears of pay in the sum of £4,064.(ii) Holiday pay in the sum of £3,048.(iii) Redundancy in the sum of £9,144.[2]It is further declared that the claimant is entitled under her contract of employment to 12 weeks’ notice from the 6 December 2018 to 28 February 2019. The claimant is entitled to contractual notice pay in the sum of £16,384.56.[3]It is declared that the Secretary of State ought to pay to the claimant out of the National Insurance Fund notice pay subject to the cap imposed by section 186 Employment Rights Act 1996 and any further reduction taking into account mitigation by the claimant.
