JUDGMENT

[1]The First Respondent failed in its duty to consult within the meaning of Section 188 and 188A of the Trade Union and Labour Relations (Consolidation) Act 1992 (TULRCA) when it proposed to make 33 employees redundant[2]The Claimants (as on the attached Multiple Schedule) were dismissed as redundant on or about 27 November 2023.[3]A Protective Award is made in respect of those employees on the Multiple Schedule in respect of whose dismissal the employer has failed to comply with the requirements of s.188.[4]The Respondents are ordered to pay remuneration to each such employee for the protected period which is the period of 90 days commencing 27 November 2023.
