Employment Tribunals Rules of Procedure 2024 – Rule 22[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £823. In the alternative, the Claimant had a contractual entitlement to the sum of £823 for work performed during employment, and this was outstanding on termination of employment, and the Claimant is entitled to damages for breach of contract for that sum (the Claimant’s agreement with the employer being that the Claimant was responsible for paying tax to HMRC on the cash sums received).[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £141.90 (12.9 hours at £11 per hour).
