Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1782.93 + £21,781.26 = £23564.19.[2]The claim for a further £2513.28 is dismissed as that would be double recovery for extra time off.[3]The respondent has failed to pay the claimant’s holiday pay entitlement and is ordered to pay the claimant the sum of £87,125.04/52 x 342/365 = £6279.62. This is based on Working Time Regulations and assumes claimant was paid for bank holidays.
