JUDGMENT

[1]The Claimant’s claims are dismissed, under rule 47 as the Claimant did not attend the hearing and gave no explanation of her non-attendance.

REASONS

[2]The Claimant did not attend the hearing on 25 May 2023. The Tribunal clerk made two phone calls and sent an email to the Claimant between 10am and 10.30am requesting her to contact the Tribunal immediately to indicate whether she was attending and if not why not. No response to either the calls, or the email were received.[3]The Tribunal considered the file in relation to this case and noted that there had been a previous final hearing in January 2023 which was postponed due to the nonattendance of the Claimant.[4]Furthermore, there was correspondence between the parties within the last 10 days in which the Claimant had indicated that she did not intend to produce a witness statement. The Respondent had also pointed out to the Claimant, the order of the Tribunal that she should do so. Case Number: 3301247/2022[5]The Tribunal therefore concluded that they could not proceed in her absence to decide the claim, as they had no evidence from the Claimant. The Tribunal therefore concluded to dismiss the claim for non-attendance at the Tribunal hearing. _
