Employment Tribunals Rules of Procedure 2024 – Rule 22[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £457.60 for the period 2 December to 6 December 2024 (8 hours per day for 5 days at £11.44 per hour).[2]For the 3 months September to November 2024, the Claimant earned £4783.64 gross or £4609.27 net. This is the best available evidence of her average salary. Her average salary was £368.98 gross per week or £354.66 net per week.[3]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £354.66 (the estimated net remuneration for one week’s notice).[4]The Claimant was employed for 212 days. The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1200.15, being 212/365 (the proportion of a year that was worked) x 5.6 (the number of weeks of entitlement for a full year) x £368.98.60 (the average weekly salary).
