JUDGMENT

[1]The time for the Respondent to present a response to the claim is extended to 12 May 2023.

REASONS

[1]By a letter dated 14 August 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because  The Claimant failed to respond to the Tribunal’s correspondence dated 23 June 2023, requiring him to comment on the Respondent’s application to extend time to present a response.  The Claimant failed to attend the Preliminary Hearing on 14 August 2023, and did not notify the Tribunal that he was unable to attend.  The Claimant did not reply to the Respondent’s communications regarding preparation for the preliminary hearing, including in relation to agreeing the contents of the bundle to be used.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 14-15 December 2023 will not take place.
