Miss K P Tata v Thames Water Utilities Ltd and J D'Costa: 3300537/2023
JUDGMENT
The complaints of breach of duty of care and breach of confidentiality are struck out.REASONS
[1]By a letter dated 9 January 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaints of breach of duty of care and breach of confidentiality should not be struck out because they have no reasonable prospect of success since they are not claims that the tribunal has jurisdiction to consider.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of breach of duty of care and breach of confidentiality is therefore struck out.[3]The claimant’s remaining claim(s) remains listed for hearing on 18-19 March 2024. _____________________________ Employment Judge George 7 March 2024[1]The Respondent’s application to strike out the following three allegations made by the Claimant is refused: 1.1. The allegation that in April 2022 the Second Respondent suggested to the Claimant that the UK might not be the right place for her to live because of her health. 1.3.
