JUDGMENT

[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the sum of £2,010.77, (15 days worked and unpaid at £115 per day and £285.77 expenses).[2]The claimant was dismissed in breach of section 86 of the Employment Rights Act 1996 in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £575, (one week’s pay).[3]For the avoidance of doubt, the total payable by the respondent to the claimant under the terms of this Judgment, without deduction, taxable in the hands of the claimant, is £2585.77.[4]The claimant should note that no claim for holiday pay was made in his claim form and no compensation for future loss is recoverable under these heads of claim.
