JUDGMENT
[1]The claimant was summarily dismissed on 31 December 2016 by reason of redundancy. The claimant is entitled to a redundancy payment calculated by reference to his age (55), his length of service of six years (start date 1 December 2010) and his weekly pay of £884.61 (capped at £479 per week). The claimant’s statutory redundancy payment amounts to £4,311.[2]The respondent is ordered to pay the sum of £4,311 by way of a statutory redundancy payment to the claimant within 14 days from the date of this order.[3]The claimant was entitled to three months’ notice of the termination of his employment. The respondent is ordered to pay the sum of £8,502.75 to the claimant in respect of breach of contract for failure to pay contractual notice within 14 days from the date of this order.[4]The claimant is entitled to 20 days accrued but untaken holiday entitlement up to 31 December 2016. Holiday entitlement is calculated at £109.01 per day amounting to a total of £2,180.19. The respondent is ordered to pay the sum of £2,180.19 in respect of accrued but untaken holiday entitlement within 14 days from the date of this order.[5]The claimant was not paid his wages between 1 April 2016 and 31 December 2016. The respondent is ordered to pay the sum of £25,508.25 in respect of Case Number: 3300040/2017 unpaid wages constituting an unlawful deduction from the claimant’s salary contrary to s.13 of the Employment Rights Act 1996, within 14 days from the date of this order.
