JUDGMENT
[1]The claim for disability discrimination is dismissed on withdrawal by the Claimant. The Claimant reserves his position in respect of pursuing a claim for personal injury arising from an accident at work in a different jurisdiction (court).[2]The claim for unlawful deduction from wages succeeds. The Respondent is to pay the Claimant the sum of £510.06 (gross) calculated as follows: 2.1 £408.50 for 43 hours worked in August 2020 but not paid @ £9.50 per hour; 2.2. £51.06 in respect of the service charge @ 12.5% usually added to his wages; 2.3 £50.50 deducted from his wages on 31 August 2020 in respect of his staff bar and food tab in excess of the amount owed[3]The claim for failure to pay holiday pay succeeds. The Respondent is to pay to the Claimant the sum of £311.11 (gross) in respect of holiday accrued in the period from 4 July 2020 to 15 September 2020 but untaken at the date of termination of employment.
