The Claimant’s claim is struck out.REASONS
[1]The Claimant has failed to comply with Employment Tribunal orders dated 8 March 2021 (EJ McLaren); 11 March 2021 (REJ Taylor) and 2 July 2021 (EJ Lewis).[2]The Claimant did not attend the preliminary hearing on 25 June 2021 which was held by EJ Lewis.[3]EJ Lewis ordered an open preliminary hearing to take place on 16 September 2021 to consider whether to strike out the Claimant’s claim on the basis that:3.1 there has been non-compliance with ET orders; and3.2 She is not actively pursuing her claim. Case Number: 3213345/2020[4]The Claimant has failed to make any representations or attend the hearing. The hearing was adjourned at 10.05 and the Tribunal clerk telephoned the Claimant twice, the calls went straight to voicemail A message was left saying that the hearing would start at 10.30am. The hearing resumed, the Claimant did not contact the Tribunal or attend.[5]The Claimant’s complaints are therefore struck out pursuant to rule 37 of the ET Rules 2013 on the grounds that:5.1 She has not complied with ET orders dated 8 March 2021, 11 March 2021 and 2 July 2021; and there has been non-compliance with ET orders; and5.2 She is not actively pursuing her claim.
