The judgment of the Employment Tribunal is that the claim is struck out.REASONS
[1]The claimant filed his claim on 13 December 2021.[2]He had worked for the respondent for 2.5 days on what has been stated to be a trial and which was terminated.[3]He has claimed extensive damages for matters including those for which the respondent could not be liable such as his rent. His total claim amounts to £6133.[4]The claimant has not taken any action in order to pursue his claim since December. The respondent submitted a response on 28 January 2022.[5]The claimant has not submitted any further evidence to substantiate his claim which the respondent says is baseless.[6]The respondent applied to the Tribunal for the case to be struck out and the Regional Judge indicated this was a matter that I would consider on the day of the hearing.[7]On the day of the hearing, the respondent attended by video link but the claimant did not attend. The Court Clerk attempted to contact the claimant by telephone on several occasions without success with the line ringing and going to voicemail.[8]The respondent renewed his application for the case to be struck out before me.[9]In all the circumstances, in the light of the fact that the case had not been actively pursued and did not attend the hearing on the date and time specified and having regard to the Procedure Rules, I found that it was fair and just in all the circumstances to strike out the claim.[10]The claim is therefore struck out. ____M Cohen___________________ Tribunal Judge Cohen acting as an
