JUDGMENT

[1]The Claimant’s unfair dismissal claim are struck out because the same claim has already been determined by the Tribunal in its Judgment dated 6 January 2022.[2]The Claimant’s race discrimination complaints are struck out as an abuse of process in that they duplicate complaints already made in case 3202629/21, or which could have been made in those proceedings.[3]Had the unfair dismissal and race discrimination complaints not been struck out for these reasons, they would have been struck out on the grounds that the Tribunal has no jurisdiction to hear them, as the Claim Form was issued after the relevant statutory time limits had expired.
