JUDGMENT
[1]The name of the Respondent is amended as above.[2]The Respondent made unlawful deductions from the wages of the Claimant.[3]The Respondent is ordered to pay to the Claimant £319.50.REASONS
[1]Mr Ali worked for Tops Pizza Seven Kings as a delivery driver from 17 August 2021 until he left on 03 October 2021.[2]The business is a franchise of Tops Pizza Ltd. It is run by Salahudin Khan. It is not a limited company. Therefore I amend the name of the Respondent to “Salahudin Khan trading as Tops Pizza Seven Kings”. 10.7 Judgment with reasons – rule 62 Case Number: 3206663/2021[3]Mr Khan did not want Mr Ali to leave. When he did leave, Mr Ali was owed 2 weeks’ pay. Mr Khan told Mr Ali that he was going to pay only 1 week’s pay, and not the other, and that is what he has done.[4]Accordingly there was an unlawful deduction from Mr Ali’s wages of one week’s pay.[5]As Mr Ali was due to be paid £319.50 a week, I order Mr Khan to pay to Mr Ali £319.50.
