JUDGMENT

[1]The allegation at paragraph 8.2.1 of the list of issues in the case management order sent to the parties on 7 June 2023 is struck out pursuant to rule 37(1)(a) of the Employment Tribunal rules 2013.[2]The claims of disability related harassment at paragraphs 5.2.1, 5.2.2, 5.2.3, 5.2.4, 5.2.5 and 5.2.7 of the list of issues in the case management order sent to the parties on 7 June 2023 are dismissed upon withdrawal by the claimant, pursuant to rule 52 of the Employment Tribunal Rules of Procedure 2013.[3]All other claims will proceed to a final hearing on 15, 16, 17, 18 and 22 October 2024. REASONS

[1]At the hearing before Employment Judge Gordon Walker on 3 November 2023, the Judge made an Order that the claimant was required to pay a deposit of £10 not later than 14 days from the date on which the Order was sent as a condition of being permitted to continue to advance each of those allegations or arguments specified in the terms of the Order.[2]The claimant has failed to pay the deposit ordered.[3]Accordingly, under Rule 39(4) Employment Tribunal Rules 2013, those allegations set out in the Judgment above are struck out.
