The Claimant’s claim is struck out.REASONS
[1]The Claimant has failed to comply with Employment Tribunal orders dated 14 March 2022 and 5 April 2022.[2]The Claimant did not attend the preliminary hearing on 4 April 2022 which was held by Employment Judge Barrrett. The Claimant did not attend the preliminary hearing today.[3]On 4 April 2022, Employment Judge Barrett ordered an open preliminary hearing to take place today to consider whether to strike out the Claimant’s claim on the basis that:3.1 there has been non-compliance with Employment Tribunal orders; and3.2 she is not actively pursuing her claim. Case Number 3205975/2021[4]The Claimant has failed to make any representations or attend the hearing. She has not corresponded with the Employment Tribunal or the Respondent in this case since 16 December 2021.[5]The Claimant’s complaints are therefore struck out pursuant to Rule 37 of the Employment Tribunal Rules 2013 on the grounds that:5.1 She has not complied with Employment Tribunal orders dated 14 March 2022 and 5 April 2022; and5.2 She is not actively pursuing her claim.[1]By a letter dated 5 April 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• the claimant had not complied with the orders of the Tribunal dated 14 March 2022 and in the minutes of the case management hearing on 4 April 2022.• it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 16 May 2022 and 11 - 14 and 18 July 2023 will not take place.
