JUDGMENT

[1]The claims are struck out for failure to comply with an Unless Order.[2]Alternatively, the claims are dismissed under Rule 47 of the Tribunal’s Rules.

REASONS

[1]On 29 November 2023 the claimant was made subject to, among other matters, the following Order (“the Unless Order”): “Unless the claimant exchanges witness statements with the respondents by 4:00pm on Monday 4 December 2023, his entire claim shall be struck out”[2]The claimant failed to comply with the Unless Order. The claimant’s claims are therefore struck out.[3]In any event the claimant failed to attend the 2-day hearing scheduled to start this morning and had his claim not been struck out by his failure to comply with the Unless Order we would have dismissed his claims (and if Case Number: 3205940/2022 necessary do so dismiss them) for his failure to attend the hearing pursuant to our powers under Rule 47 of the Tribunal’s Rule of Procedure 2013.[4]The hearing fixed for 7 and 8 December 2023 will not take place.
