The claim is dismissed.REASONS
[1]By a letter dated 09/05/2023 the Employment Tribunal gave the Claimant an opportunity to confirm that he was pursuing his claim because it appeared to the Employment Tribunal that the Claimant was not actively pursuing his claim. The Claimant has not to date responded, but the Employment Tribunal notes that on 16 March 2023 ACAS informed the Tribunal that the Claimant had communicated with ACAS indicating that his claim for wages had been resolved by payment of the wages by the Respondent.[2]The hearing fixed to take place by CVP at 14.00 on 22/05/2023 shall not take place.
