The Respondent’s application for costs is refused.REASONS
[1]Although I am satisfied that the Claimant’s conduct of the proceedings, in not attending the Preliminary Hearing on 8 June 2022 was unreasonable (for the reasons set out in the Unless Order sent to the parties on 1 July 2022), I have decided not to exercise my discretion to award costs. The Claimant’s case having been dismissed by reason of his failure to comply with the Unless Order, I have concluded that a costs award in addition would be unnecessarily punitive.
