[1]The Claimant’s claim for unauthorised deduction of wages pursuant to Section 21 Employment Rights Act 1996 succeeds.[2]A Remedy Hearing will take place on 27 May 2022 at 10am by telephone with a time estimate of 1 hour to determine the amount to be awarded to the Claimant. The Claimant is entitled to recover the total of £330.48 gross by way of unauthorised deduction of wages being:a. £187.92 gross for underpaid holiday leave taken during March 2021 (108 x £1.72); andb. £142.56 for failure to pay the Claimant double time for working on the Bank Holidays on 3 May 2021 and on 31 May 2021, namely 16 x £8.91 in circumstances where the Respondent’s own records show £17.82 as the applicable hourly rate of pay on those dates.
