JUDGMENT
The Claimant’s claim for unpaid wages is dismissed, the Claimant having failed to pursue her claim at the listed final hearing.REASONS
[1]The Claimant was sent a notice of hearing, listing today’s final hearing, on 20th August 2021. That notice provided that the hearing would be conducted by telephone and further provided detailed instructions on how to join the hearing.[2]The claimant was also emailed on 6th December 2021, with the Tribunal seeking a copy of her contract of employment and any pay slips. The letter of 6th December 2021 referred to the hearing of this matter on 10th January 2022.[3]Both the above documents were sent to the Claimant at the email address on her Form ET1.[4]The hearing started at 12:00 as listed but the Claimant did not join the hearing. The hearing was kept open until 12:15, with neither party joining Case Number: 3205226/2021 by that time.[5]It appears from the papers that the Respondent may not have been properly served, the only address that was used for service being that of Las Iguanas in the Lakeside Shopping Centre, that apparently being a client company of the Respondent and the Claimant’s place of work, not the registered address of the Respondent company.[6]The Claimant having not participated in the listed hearing at 12:00 today, the Clerk telephoned the Claimant on the mobile telephone number provided on her Form ET1. The clerk also emailed the Claimant at the email address provided on her Form ET1. She did not respond.[7]Accordingly, the Claimant having not pursued her case at final hearing, the Tribunal has dismissed her claim. _
